 Section 1 WHY DO YOU NEED REGISTRATION?

By registering for free as a private user, you may:
- be granted additional discounts depending on the overall amount of orders as from the time of registration in the on-line shop;
- place orders without entering your personal data or delivery of commodities requisites every time, thus saving time;
- request the receipt of regular information about the commodities from website, new offers as well as discounts and bargain-sales;
- request additional information for any commodity;
- participate in our games and competitions;
- participate in our promotions available to registered users only;
- Registration DOES not bind you in any way to place orders.

You are allowed to place orders even without being registered user, yet in such a case you are deprived of the privileges granted to registered users.

 

Section 2 INFORMATION SECURITY

Your personal data as well as your e-mail address will not be made public or conceded to third parties in whatever way.
We use the data you publish solely for the purpose and in connection with the operation of this Internet (on-line) shop and in compliance with the legislature of the Republic of Bulgaria.

Section 3 CONTENTS OF THE TERMS IN USE

"User" means any physical person acquiring commodities or using services not designated for trade or professional activity, and acting beyond the scope of his business or professional activity.
"Commodity" means material products offered by this online shop and designated for users, delivered or provided to users against consideration, and in some cases – for free.
"Order" means user’s request for purchase of selected commodity, placed as per instructions for placing orders.
„Supplier" means business company, owner of this on-line shop, with whom the user enters into contract for sale and purchase of commodity.

 Section 4 GENERAL CONDITIONS FOR PLACING AN ORDER, CONTRACTING OF SALE AND PURCHASE, AND DELIVERY:

 1/ Description of technical steps for placing an order (agreement of contract) and the legal effect thereof, technical means for finding and elimination of error when entering data as well as information about the languages in which you can place the order and receive confirmation as user.

If you wish to utilize all privileges provided in our website, first of all register as user and then follow the steps described below:

Placement of order is made in 3 (three) steps as described below:
On the page containing detailed information about the selected product you will see a link named “Buy”. By clicking on the same link you add the selected product to your consumer’s basket – step 1 (one).

Registered users can place an order upon entering their personal profile and once having being entered, personal and delivery data do not request repetitive filling in, except in cases of modifications therein. Registration is not obligatory, yet non-registered users must obligatory fill in the following information in step 2 (two), whilst the registered ones confirm the already entered data:

- place
- address
    2. Delivery data if different from personal data:
- Name
- place
- address

By clicking the “Order” button in step 3 (three) you confirm the intent to purchase the selected commodity/commodities and accept the specifications stated, such as: color, dimensions, model, price etc. and agree with all the conditions of this electronic shop. Registered users may order upon entering their personal profile.

Prior confirming your order, please, select the payment mode for selected commodities. Brutal Street Life EOOD offers the flowing payment modes:

- CAD (cash on delivery) on acceptance of commodities at the specified address for delivery -This payment mode is applicable only on the territory of Republic of Bulgaria
- in advance to the bank account of Brutal Street Life EOOD all bank fees are at the charge of the User:

Upon confirmation of your order and agreement with the conditions for use of www.brutaljeans.com, you will receive a call at the number you have specified, for additional clarification of all delivery details. You will further receive a prompt e-mail with confirmation for the acceptance of your order with description of the purchased products, Order number, date, your personal data and delivery details. Orders placed by 18.00 hrs. are handled on the subsequent day.  In case errors are found in order placed, we reserve the right to suspend the execution until the additional and final clarification of all details through telephone call on the number or e-mail address specified by you.
The orders through www.brutaljeans.com may be placed in Bulgarian or English with the conditions specified being valid in both language versions.

 

2/ Description of delivery terms and conditions, including name of Courier service, delivery costs, terms and mode of payment, terms for delivery etc.

Products ordered from www.brutaljeans.com will be delivered by Speedy Courier service to the address specified by you This is applicable for deliveries only on the territory of Republic of Bulgaria. For orders outside Republic of Bulgaria - the User shall inform the Supppliert for the name of the Courier service. The supplier shall arrange the transport after informing the user for the costs of the transportation  and after the user' approval.

For orders valued over BGN 300.00 delivery is FREE OF CHARGE FOR THE OVERALL TERRITORY OF BULGARIA, with terms of 1 working day for Speedy AD.
For all remaining orders, carriage is payable by the Client.

Delivery costs are determined by:
    - type of delivery;
    - commodity weight;

The most frequent carriage price for the territory of Republic of Bulgaria is between BGN 6.00 and 15.00.

We will bear for our account all the remaining costs for insurance of commodities!
Upon handling your order, you will receive by return e-mail the Bill of Lading Number to trace the exact location of the commodity you have ordered at any time. This is facilitated through Speedy website by entering “Tracing” menu.
For shipments dispatched under COD terms, you’ll have to pay the value of ordered commodities plus Courier’s service charge.

For shipments where the value of the commodity is paid through banking channels (transfer), debit or credit card, you’ll have to pay the Courier’s service charge ONLY.
We are well aware of the fact how important it is for you to receive exactly what you expect, and that is why we always inspect each individual order for possible defect.
Orders placed by 18.00 hrs. are handled with us on the subsequent day. Deliveries are made by Speedy AD with terms of one working day for all places on the territory of Republic of Bulgaria, save those covered by service schedule listed in the website of Speedy AD.

3/ Information about the way the User receives the official purchase documents – cash bond and/or invoice with cash bond.
Delivery of commodity is supported by cash bond or invoice with cash bond certifying the purchase and the value thereof.

 

4/ Information about the major clauses of the remote delivery contract

The contract is deemed agreed as from the time the User accepts the terms and conditions offered by the Supplier and places the order.
For delivery of commodities subject of the contract, the User confirms the validity of the contract and his agreement with the general conditions of the Supplier by signing the Bill of Lading supporting delivery.
The user shall pay the specified price in Bulgarian Leva or in Euro. The price of commodity shall be the one specified at the time of placing the order in the remote offer. The same shall cover the value of commodity plus VAT.
In addition to the price, the User shall pay the amount of the costs for delivery to the address he has specified, save the cases when the value of the order exceeds BGN 300.00.

in cases requesting for reimbursement of partial or total payments by Supplier in favor of User, these are made through banking channels to the card account of the User.

Section 5 INFORMATION about SPECIFICATIONS of COMMODITIES and LIABILITIES:

1/ Specification of commodity sizes (dimensions) is provided on the page of each individual product. In order to avoid problems related to commodity sizes (dimensions), you kindly requested, when placing an order, to specify in the field additional information in step 2 of the process, your own sizes (dimensions) as follows:

- for outer cloths – chest and neck measurement, and sleeve length;

- for jeans and trousers – waist, haunch measurement and leg length.

2/ Specifications of commodity colors are provided on the page of each individual product. Please, be advised that colors appear in different way on various monitors.

3/ Specifications of commodity materials are provided on the page of each individual product facilitating the selection of the size desired.

4/ Information about packing: the commodities are delivered in bags packed in the  courier 's standard packing.

5/ Liabilities
In case the commodity you desire may not be provided or a delay in accomplishment of the order is anticipated, you will be advised by phone or e-mail, accordingly.

 

Section 6 INFORMATION about CLAIMS

 Claims shall be accepted in case the commodity has NOT been used, yet bearing defects.
We guarantee that the commodity we deliver upon User’s order, comprises all the qualities stated in the offer.

Immediately upon the receipt of commodity, you will have to inspect the compliance of the same with the order. In case of non-compliance or the appearance of hidden defects or shortages, you will have to put a claim in writing as provided for by Article 125 of the law on Consumer protection.

In such cases you are entitled to put a claim requesting for bringing the commodity in a compliance with the sale and purchase contract or replacement with new one, depending on the cause for the claim.

The same rights refer to the cases of finding hidden defects and shortages (torn, unraveled, discolored fabric, spots, missing buttons, belts etc. of the kind) substantially deteriorating the fitness of commodity for designated purpose.

In both cases the costs for elimination of defects shall be for our account.

Section 7 INFORMATION about the exercise of Consumer’s rights pursuant to Article 55 of the Law on Consumer Protection.

In case the commodity received does not satisfy your expectations without being defective, we will accept it back and reimburse the amount paid by you.
In order to exercise this right, the following conditions shall be met – you will have to state in writing your intent to recede from the contract and to specify the bank account for reimbursement of the amount already paid, to satisfy the general conditions, to return the commodity with the integrity of manufacturer’s packing being not deteriorated, the commodity not being used or handled in whatever way, bearing all the labels, in the packing you have received it, and supported by the cash bond, latest 7 (seven) days from the date of receipt, with the carriage costs of return being for your account.
You, as consumer, bear responsibility for the commodity and supporting documents until the time of receipt with us. In case you have returned the commodity in due course and in compliance with the specified conditions, we will reimburse to you the amount of the purchase price latest 30 calendar days as from the date you have exercised your right of rescission from the contract, deducted by carriage costs.
